MODACK’S HIGH COURT APPEARANCE POSTPONED

ALLEGED gang leader Nafiz Modack and his co-defendants in the Charl Kinnear murder trial were scheduled to appear in the High Court after a six-month hiatus, but their return has been delayed.

The postponement follows reports that Judge Robert Henney was unavailable due to illness this week, necessitating a rescheduling of the trial.

Since the break in March, Modack has officially become a bandiet after being sentenced to seven years in prison by the Cape Town Regional Court for offering a police officer R146,000 in bribes for preferential treatment.

The dik ding appeared alongside 14 other co-defendants, including alleged leader of the Terrible West Siders, Moegamat Toufeek “Bubbles” Brown.

They are facing over 100 charges, including murder and money laundering, related to the murder of Kinnear, who was shot outside his home in Bishop Lavis in September 2020.

Defence attorney Inge Jansen, representing Bubbles, Fagmeed Kelly, and Jacques Cronje, informed the court that bail applications for Bubbles and Cronje were submitted in June and will be heard in due course.

Bubbles had previously been represented by Nazeer Parker, who withdrew from the case after facing drug charges related to his former clients.

This follows Bubbles and his co-defendants’ arrest by the Hawks after meth was smuggled into the courtroom.

The last session of the trial featured Modack’s testimony, in which he denied involvement in the murder and claimed he was being unjustly targeted by police who he alleges were colluding with his known adversaries, the deceased Mark Lifman and Jerome “Donkie” Booysen, to thwart his purported attempts to eliminate drugs from city nightclubs.

He also launched a barrage of accusations against former top officers Major-General Jeremy Vearey and the late Major-General Andre Lincoln.

In a series of claims, he alleged that police officers were being compensated by supposed underworld figures to unlawfully raid his residences, intimidate his family, and even kill him while he was incarcerated.

The case is now set to resume on 13 October.
